Peshawar High Court’s division bench on 27th February 2018 ruled in favor of the immediate release of 25 individuals who were previously given the sentences to serve three to four years in prison. Justice Syed Atiq and Justice Lal Jan Khattak of the division bench approved the bail request of the 25 individuals.

Iqbal Khan, Mashal’s father previously filed an appeal in the High Court, demanding more serious punishment for those who were accused. In the filed petition, Iqbal Khan pleaded that the five individuals who were given life imprisonment sentence should now be held on a death row.

In his plea, he also demanded an increase in the sentence of those who were awarded four-year sentences. However, due to lack of evidence, ATC decided to acquit those 26 individuals who were arrested due to their presence on the crime scene. They were initially released on the same night.

Additionally, the 25 more individuals were granted the bail to be released.

According to the JIT formed to probe the case, it stated that the murder was premeditated based on the Awami National Party who threatened to kill Mashal who voiced against the irregular activities in his university.

After the 26 accused were released, they received a grand welcome in Mardan and Swabi.
